Apple agrees to $53 million settlement for some iPhones, iPods denied warranty coverage

Documents have been filed in the United States District Court for the Northern District of California for a $ 53 million settlement between Apple and customers denied warranty coverage on their iPods and iPhones due to water damage. The case is due to Apple’s policy not to extend warranty coverage on devices where the indicator tape inside them showed exposure to liquids, however plaintiffs in the class action lawsuit argued the indicator could change color due to moisture or humidity. Apple does not acknowledge any wrongdoing in the settlement, which is still awaiting approval from the court, however customers with warranty claims denied prior to June 2010 (iPod touch) or December 31st, 2009 could be eligible for as much as $ 300 depending on the device owned and how many claims are filed. The scenario the plaintiffs cite is just the kind of thing we worried about back in 2006, and will probably remain in the back of our minds if we need to have any of our hardware serviced in the future no matter how much Apple and others work on more advanced detection systems.

We’re happy to oblige: Samsung is asking Judge Paul Grewal to amend its patent infringement allegations to include Apple’s latest 4th and 5th generation iPad and iPod Touch, as well as the 7.9-inch iPad mini. Sammy says it’s arguing on the side of efficiency, noting that the new hardware is up against the very same claims as the iPhone 5 it added to the case last week, asserting that their inclusion wouldn’t be a burden to the court. Grewal, who was expecting this motion, is also being asked to decide if older iPod hardware is covered by Samsung’s original infringement contention, which vaguely described “all Apple products including a built-in speaker and an external audio output port,” as violators. The Judge also recently approved Samsung’s request to sneak a peek at HTC and Apple’s recent settlement agreement. The proceedings seem to keep Grewal and his gavel busy, but at least your legalese loving uncle will have something to drone on about over Thanksgiving dinner.

Amazon Kindle EBook Users To Get Refunds After Settlement



hypnosec writes “Amazon, in an email to Kindle owners, has a revealed that following the settlement in the eBook price fixing lawsuit customers will be entitled to refunds between 30 cents and $ 1.32 on each book purchased. If the $ 69 million settlement is approved, the funds will be provided as credits to customers directly in their accounts. Users may request checks for the amount of credit that has been applied to their accounts. “‘f the Court approves the settlements, the account credit will appear automatically and can be used to purchase Kindle books or print books,’ wrote Amazon in the email.”

FTC considering new settlement process so companies can't deny wrongdoingGoogle recently paid the FTC $ 22.5 million and Facebook was ordered by the commission to change the way it handles data, but you might be surprised to hear that both companies did nothing wrong. Well, not exactly, but by settling their privacy violation cases, the internet giants are entitled to deny any misconduct. The New York Times reports that J. Thomas Rosch, a commissioner who voted against both settlements, feels that current rules will invite “denials of liability in every case in the future.” Rosch wants the policy changed so companies can’t deny responsibility when settling, much like the way the SEC handles similar indiscretions. Most of his colleagues weren’t in a hurry to back his opinions, but three did say that refining the process could “avoid any possible public misimpression” of how the FTC strikes such deals. The commission is expected to look at the issue in the near future, but until then, we’re sure you’re more than able to separate the reality from the legalese.

Facebook’s Settlement With FTC Confirmed: Privacy Changes Must Be Opt In

Facebook CEO Mark Zuckerberg just issued a statement on the Facebook Blog confirming that his company has settled with the FTC over charges that it has violated user privacy over the year. Facebook is now  ”required to obtain consumers’ affirmative express consent before enacting changes that override their privacy preferences”, effectively making all future privacy control changes opt in. Facebook must also submit to privacy audits every 2 years for the next 20 years, bar access to content on deactivated accounts, and avoid misrepresenting the privacy or security of user data. Zuckerberg’s statement and the press release from the FTC confirm reports of a coming settlement from earlier this month.
